Introduction

AMBDavis Equity Coaching, LLC and its affiliates and related entities (collectively, “Company,” “us,” or “we”) is/are committed to protecting the privacy of certain data that is collected from you and that you submit when you access this website or websites, apps, or other online media under our operation and control (collectively, the “Site”). The nature of our business requires that we gather and maintain information that is of a personal nature that you wish to keep protected. This Privacy Policy (“Policy”) describes our policies and practices regarding the collection, use and disclosure of personal data you submit or we obtain in connection with your use of this Site. This Privacy Policy applies to your use of this Site and by accessing or visiting the Site you are indicating your understanding that the collection, use, and sharing of your personal data is subject to this Policy. Please read this Policy carefully before using the Site or submitting personal data to us.

Changes to this Policy

Changes to this Policy. We reserve the right to change this Policy at any time. In the event we make material change(s) to the Policy, we will provide notice through the Site. Changes will be effective immediately upon posting to the Site and will apply to your use of the Site after the “effective date” listed above. You understand and agree that your continued use of the Site after the effective date, means that the collection, use, and sharing of your personal data is subject to the updated Policy. Except to the extent we obtain your consent or as permitted or required by applicable law, we will handle your personal data collected through the Site in accordance with the terms of the Policy in effect at the time of such collection.

As you are aware, we may collect information from a variety of sources to operate the Sites, carry out our business, comply with law and other purposes described herein.

    And other types of personal data that you choose to provide to us or that we may obtain about you.

You do not have to provide the above personal data to access or use the other sections of the Site. At no time will we ask you to provide sensitive data (e.g., race, ethnicity, political opinions, religious/philosophical beliefs, trade union membership, physical/mental health, sexual orientation, or criminal record) in connection with your use of the Site.

We collect data about you from third parties.

  • Personal Data From Third Parties. We may collect personal data about you from third parties such as through your social media services consistent with your settings on such services, and from other third-party sources that are lawfully entitled to share your data with us. We use and share this personal data (and may add it to the other information we have on file for you) for the purposes described in this Policy.

We collect data through your use of the Site.

  • Information On Your Use. We may collect information about and log your visits and use of the Site. This includes, for example, when you view or click on embedded content. We also use cookies and internet protocol (“IP”) addresses to identify you and log your use of the Site. For more details see below.

We collect statistical information concerning Site usage.

  • Statistical Data. To monitor utilization of the Site and continuously improve its quality, we may compile statistical information concerning the usage of the Site using analytics services, such as those provide by Google Analytics. Examples of this information would include: the number of visitors to the Site, or to sections or pages within the Site, patterns of traffic flowing through the Site, length of time spent on the Site, or in sections or pages of the Site, the other sites that refer visitors to the Site, the pages of the Site that visitors frequently use as entry and exit points, utilization of the browser and operating systems and versions used by visitors to the Site. The analytics services may transfer this information to third parties in case of a legal obligation or if a third party processes data on behalf of that service. To compile this information, we may collect and store:
    Your IP address
    Your operating system version
    Your browser version
    The pages you visit within the Site
    The length of time you spend on pages within the Site
    The site from which you linked to ours Search terms you used in search engines which resulted in you linking to the Site, etc.

  • Google Analytics and Advertising.  We may also utilize certain forms of display advertising and other advanced features through Google Analytics, such as Remarketing with Google Analytics, Google Display Network Impression Reporting, the DoubleClick Campaign Manager Integration, and Google Analytics Demographics and Interest Reporting. These features enable us to use first-party cookies (such as the Google Analytics cookie) and third-party cookies (such as the Doubleclick advertising cookie) or other third-party cookies together to inform, optimize, and display ads based on your past visits to our websites. We may also merge data from Google Analytics with data from other Seramount’s databases to personalize your experience on our website. You may control your advertising preferences or opt-out of certain Google advertising products by visiting the Google Ads Preferences Manager, currently available at  https://adssettings.google.com.

You can opt-out of third-party cookies from Google Analytics using the Google Analytics opt-out browser setting add-onor third-party ad management tools.

While all of this information can be associated with the IP address your computer had while you visited the Site, it will not be associated with you as an individual, or associated with any other personal data you may submit through the Site, or that we may store about you for any other purposes.

We collect data through cookies and similar technology.

  • Cookies and Similar Technology. We may use technologies such as cookies, pixel tags, browser analysis tools, server logs and web beacons to recognize you when you return to the Site and to help us improve the quality of our service when you visit our Site. We also use cookies to tailor our products, services and advertising to suit your personal interests, estimate our audience size, track visits to and sales at our Site and, as applicable, to process your order, and track your status in our promotions, contests and sweepstakes.

You may control cookies, including preventing or stopping the installation and storage of cookies, through your browser settings and other tools. If you do so, our Site may not function correctly. Please refer to the Help feature of your browser for information on disabling cookies.

IMPORTANT: By using the Site, you consent to the processing of any personal data for the analytics purposes and functions described above.

How we use your personal data

In general, we will use the personal data we collect about you only for the purpose it was collected, for compatible purposes, as permitted or required by law, as necessary to carry out our contractual duties and obligations, and as otherwise provided in this Policy. For example, we may use your data:

  • To respond to your requests for information relating to our products
    and services.
  • To communicate with you. We will send you messages about the availability of our Site, security, or other service-related issues. You may change your communication at any time. Please be aware that you cannot opt-out of receiving service messages from us, including security and legal notices.
  • In connection with your employment or prospective employment. If you submit personal data through the Site in connection with an application for employment or as part of the onboarding process, we will use that data in connection with the employment or prospective employment relationship.
  • For our research and development efforts. We use data, including public feedback, to conduct research and for the development of the Site and the services and products we provide to you.
  • For other everyday business purposes. By way of example, product development, contract management, IT and website administration, fulfillment, analytics, fraud prevention, corporate governance, reporting and legal compliance.
  • To provide you with the products and/or services you have ordered or requested. This might include whitepapers, books, digital materials.
  • To market our products or services that we think may be of interest
    to you. For example, to send you newsletters and promotions using any
    communications preferences you have expressed. We may provide these
    communications via email, postal mail, online advertising, social media,
    telephone, text message (including SMS and MMS), push notifications,
    in-app messaging, and other means.
  • To ensure your personal data is accurate and to personalize our
    products and services. For example, we may aggregate your personal data with data from third-party sources for purposes of keeping information up to date. We also rely on information from third parties in order to provide better, more personalized service. If you connect your social media services or other accounts to our services, we may use this information to make your experiences with us more personal and social, or share and use it as described elsewhere in this Policy.
How we share your data

We disclose your data to third parties to help us manage the Site, to provide you with products/services, to market to you, to enhance our services, and to protect legal rights and interests. In general, we will not disclose your personal data collected through the Site except with your consent and as described in this Policy. We may disclosure your data for the same reasons that we may use it as described in this Policy, which includes disclosing it to our affiliates and non-affiliated entities, as we deem necessary to carry out those purposes.

  • Third Party Vendors. We may need to use or disclose this personal data with our third party vendors:
    With your consent or as you direct;
    To manage the Site;
    To provide you with products, services, or offers;
    To engage in marketing activities;
    To enhance our services by, among other methods, obtaining assistance with providing more personalized services to you through analytics and other technologies;
    To protect our interests and legal rights, such as through responding to subpoenas and defending litigation;
    To protect against and prevent fraud, illegal activity (such as identifying and responding to incidents of hacking or misuse of our websites and mobile applications), and claims and other liabilities; and
    To review and process applications for employment.

We endeavor to choose affiliates and non-affiliates with similar standards to ours regarding the protection of data.

We disclose your data in connection with legal process, to protect the security or integrity of the Site, to defend ourselves, and to protect others.

  • Legal Process, Security, Defense, Protection. It is possible that we will need to disclose personal data about you if required by law, subpoena, or other legal process. Additionally, we may disclose personal data about you if we have a good faith belief that disclosure is reasonably necessary to: demonstrate our relationship with you;
    investigate, prevent, or take action regarding suspected or actual illegal activities or to assist law enforcement agencies; protect the security or integrity of the Site; investigate and defend ourselves against any third-party allegations or claims; or protect the rights and safety of others.

We may disclose your data in connection with a sale, acquisition, merger, or change in control.

  • Change in Control or Sale. We can share, sell, assign, or license your personal data in connection with certain business transactions, such as a sale, acquisitions, merger, or change in control, or in preparation for any of these events. In such cases, we will take appropriate steps under the circumstances and to the extent possible to ensure that the recipient agrees to provide privacy protections substantially similar to those established by this Policy. Any entity that acquires all or substantially all of the Company’s assets will have the right to continue using your data consistent with this Policy or as otherwise agreed to by you.

In no case will we share, sell or license your data to third parties, except as set forth above or as required or permitted by law.

Social Media Plugins

This Site uses social media plugins (e.g. Facebook and LinkedIn) to enable you to easily share information with others. When you visit our Site, the operator of the social plugin can place a cookie on your computer, enabling that operator to recognize individuals who have previously visited our Site. If you are logged into the social media website (e.g. Facebook, Twitter) while browsing our Site, the social plugins allow that social media website to share data about your activities on our Site with other users of their social media website. For example, Facebook Social Plugins allow Facebook to show your Likes and comments on our pages to your Facebook friends. Facebook Social Plugins also allow you to see your friends’ Facebook activity on our website. We do not control any of the content form the social media plugins. For more information about social plugins from other media websites you should refer to those sites’ privacy and data/information sharing statements/policies.

Safeguarding of Personal Data

No system for safeguarding personal or other data is 100% secure and even though we have taken steps to protect your personal information from being intercepted, accessed, used or disclosed by unauthorized persons, we cannot fully eliminate security risks associated with personal data. However, we take a number of steps to safeguard the security of personal data obtained through the Site. For example, we have implemented a security program that contains administrative, technical and physical controls that are designed to reasonably safeguard your personal data from unlawful use, unauthorized access or disclosure. However, again, there is no guarantee that data may not be accessed, disclosed, altered, or destroyed by breach of any of our administrative, physical, or technical safeguards.

Do Not Track

 “Do Not Track” is a privacy preference that you can set in your Internet search browser that sends a signal to a website that you do not want the website operator to track certain browsing information about you. However, because our Site is not configured to detect Do Not Track signals from a user’s computer, we are unable to respond to Do Not Track requests

Links to Third Parties’ Sites

 We may provide links to websites or resources outside of our Site for your informational purposes only. You acknowledge and agree we are not responsible for the availability of such sites or resources, and do not endorse and are not responsible or liable for any content, advertising, goods, services or other materials on, available through or provided by such sites or resources. We are not responsible for the privacy or other practices of such sites and cannot guarantee the security of any of your personal data that you provide or may be collected by such sites. We encourage you to review the privacy policies and terms and conditions on those linked sites

Information of Children

The Site is not directed to children as the products and services on this Site are intended for persons 18 years of age and older. The Company does not knowingly collect, use or disclose any personal data from children. If you are concerned about your child’s use of the Site, you may use web-filtering technology to supervise or limit access to the Site.

 

Applicable Law

This Policy is governed by the internal substantive laws of North Carolina, without regard to its conflict of laws principles. Jurisdiction for any claims arising under or out of this Privacy Policy shall lie exclusively with the state and federal courts within North Carolina. If any provision of this Policy is found to be invalid by a court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this Policy, which shall remain in full force and effect.

For California Residents

This policy was last updated on September 23, 2021.

Pursuant to California Civil Code Section 1798.83, residents of the State of California have the right to request from companies conducting business in California a list of all third parties to which the company has disclosed certain categories of personal information during the preceding year for the third parties’ direct marketing purposes, and the categories of personal information the company shares.

Alternatively, the law provides that a company may comply, as AMBDavis Equity Coaching does, by disclosing in its privacy policy that it provides consumers choice (opt-out or opt-in) regarding sharing personal information with third parties for those third parties’ direct marketing purposes, and information on how to exercise that choice. As stated in the Privacy Policy, AMBDavis Equity Coaching provides you choice prior to sharing your personal information with third parties for their direct marketing purposes. If you choose to opt-out or at the time AMBDavis Equity Coaching offers that choice, AMBDavis Equity Coaching does not share your information with that identified third party for its direct marketing purposes.

Data protection principles

AMBDavis Equity Coaching is committed to processing data in accordance with its responsibilities under the CCPA, and in particular with regard to the principles articulated therein which affirm a right to privacy, provide California consumers should be able to exercise control over their personal information, and provide that there are safeguards against misuse of their personal information.

Those principles require that where this organization collects personal information about a consumer who is a California resident (“Consumer” or hereinafter “consumer”) the Consumer has a right to request disclosure of:

  • the categories and specific pieces of personal information we collect;
  • the categories of sources from which that information is collected;
  • the business purposes for collecting or selling the information;
  • the categories of third-parties with which the information is shared;
  • disclosures about the information, and
  • the purposes for which the information is used.

Those principles also require upon verified request:

  • the deletion of personal information;
  • disclosure of the categories of information collected that we sell or disclose; and
  • the disclosure of the identity of third-parties to whom the information was sold or disclosed;

And, among other rights,

  • authorize the Consumer to opt out of the sale of personal information; and
  • prohibit discrimination against the Consumer for exercising privacy rights.
  • We are committed to supporting those rights and do so with the following policy provisions.

General provisions

  • This policy applies to all California resident consumer personal information (“Consumer Data”) processed or controlled by AMBDavis Equity Coaching.
  • Personal information (“Consumer Data”) means information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. It includes identifiers such as a real name, alias. postal address, unique personal identifier, online identifier, Internet protocol address, email address, account name, social security number, driver’s license number, passport number or anything similar.
  • The Responsible Person shall take responsibility for AMBDavis Equity Coaching’s ongoing compliance with this policy.
  • This policy shall be reviewed at least annually.
  • AMBDavis Equity Coaching shall comply with an order of the California Attorney General.
  • AMBDavis Equity Coaching shall seek to cure violations of the CCPA within 30 days of written notice of alleged noncompliance by a consumer. (1798.155)
  • To ensure its processing of data is lawful, fair and transparent, AMBDavis Equity Coaching shall maintain a Register of Systems, which shall include a list of systems, co-controllers, processors and sub-processors.
  • The Register of Systems shall be reviewed at least annually.

Lawful, fair, and transparent processing (1798.100)

  • Where AMBDavis Equity Coaching collects personal information about a Consumer, upon receipt of a verifiable Consumer request, AMBDavis Equity Coaching shall disclose to that consumer the categories and specific pieces of personal information the business has collected and shall disclose and deliver promptly and free of charge. See 5(a) and (b) below for the information to be provided.
  • Where such information is disclosed and delivered, it shall, be delivered by mail or electronically, and, if delivered electronically, it shall be provided in a portable form and, to the extent technically feasible, delivered in a readily useable format that allows the consumer to transmit this information to another entity without hindrance.
  • Where AMBDavis Equity Coaching collects a Consumer’s personal information, it shall, at or before the point of collection, inform consumers as to the categories of personal information to be collected and the purposes for which the categories of personal information shall be used. AMBDavis Equity Coaching shall not collect additional categories of personal information or use personal information collected for additional purposes without providing the Consumer with notice.

Right to be forgotten (1798.105)

  • Where AMBDavis Equity Coaching collects personal information about a Consumer, it shall, upon verified request, delete any personal information about the Consumer which AMBDavis Equity Coaching has collected from the Consumer from its records and direct any service providers to delete the Consumer’s personal information from their records.
  • Where AMBDavis Equity Coaching collects personal information about a Consumer, it shall disclose to the Consumer the Consumer’s rights to request the deletion of the Consumer’s personal information.
  • This right to be forgotten shall not prevent AMBDavis Equity Coaching from using the Consumer’s personal information to:
    • complete the transaction for which it was collected,
    • detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity,
    • debug to identify and repair errors that impair existing intended functionality,
    • comply with the California Penal Code,
    • engage in public or peer-reviewed scientific, historical, or statistical research in the public interest,
    • enable solely internal uses that are reasonably aligned with the expectations of the consumer based on the consumer’s relationship with the business, or
    • comply with a legal obligation or otherwise use the information in a lawful manner compatible with the context in which the information was given.

Right to be informed

Where AMBDavis Equity Coaching collects data

  • Where AMBDavis Equity Coaching receives a verified request under Section 3(a) above, AMBDavis Equity Coaching shall provide to that Consumer:
    • (1) the categories of personal information it has collected about that Consumer,
    • (2) the categories of sources from which the personal information is collected,
    • (3) the business or commercial purpose for collecting or selling personal information,
    • (4) the categories of third parties with whom the business shares personal information and
    • (5) the specific pieces of personal information it has collected about that Consumer. (1798.110 ab)
  • In so providing, AMBDavis Equity Coaching shall identify by category or categories the personal information collected about the consumer in the preceding 12 months by reference to the above enumerated category or categories that most closely describes the personal information collected. (1798.130.3)
  • Where AMBDavis Equity Coaching collects personal information about a Consumer, it shall disclose to the Consumer the Consumer’s rights to request the deletion of the Consumer’s personal information.
  • This right to be forgotten shall not prevent AMBDavis Equity Coaching from using the Consumer’s personal information to:
  • Where AMBDavis Equity Coaching collects Consumer Data, AMBDavis Equity Coaching shall disclose the following information concerning its practices over the past 12 months in its online privacy policy or policies and in any California-specific description of consumers’ privacy rights (or if AMBDavis Equity Coaching does not maintain those policies, on its Internet Web site) and update that information at least once every 12 months:
    • (1) the categories of personal information it has collected about Consumers,
    • (2) the categories of sources from which the personal information is collected,
    • (3) the business or commercial purpose for collecting or selling personal information,
    • (4) the categories of third parties with whom the business shares personal information
    • (5) the specific pieces of personal information it collects about Consumers. (1798.110c)
  • In so disclosing, AMBDavis Equity Coaching shall provide a description of consumers’ privacy rights, updated at least every 12 months, and list the categories of personal information it has collected about consumers in the preceding 12 months by reference to the enumerated category or categories that most closely describe the personal information collected. (1798.130.5ab)

Right to opt-out

  • AMBDavis Equity Coaching may not sell Consumer personal information unless the Consumer has been given the right, at any time, to opt-out. (1798.120a)
  • AMBDavis Equity Coaching shall not sell Consumer Data that has been sold to it by another business unless the Consumer has received explicit notice and given the opportunity not to sell that consumer’s personal information (known as the right to opt-out). (1798.115d)
  • AMBDavis Equity Coaching may not sell Consumer personal information unless the Consumer has been provided notice that this information may be sold and that consumers have the right to opt out of the sale of their personal information. (1798.120b)
  • Such notice shall be in a form that is reasonably accessible to consumers and:
    • (1) provide a clear and conspicuous link on AMBDavis Equity Coaching’s Internet homepage, titled “Do Not Sell My Personal Information,” to an Internet Web page that enables a consumer, or a person authorized by the consumer, to opt out of the sale of the consumer’s personal information, and
    • (2) include a description of a consumer’s rights , along with a separate link to the “Do Not Sell My Personal Information” Internet Web page in:
      • (A) online privacy policy or policies if any,
      • (B) any California-specific description of consumers’ privacy rights. (1798.135a)
  • AMBDavis Equity Coaching, if it sells consumer’s personal information, shall:
    • ensure that all individuals responsible for handling consumer inquiries about the business’s privacy practices or the business’s compliance are informed of all requirements and how to direct consumers to exercise their rights,
    • for consumers who exercise their right to opt out of the sale of their personal information, refrain from selling personal information collected by the business about the consumer,
    • for a consumer who has opted out of the sale of the consumer’s personal information, respect the consumer’s decision to opt out for at least 12 months before requesting that the consumer authorize the sale of the consumer’s personal information, and
    • use any personal information collected from the consumer’s opt-out request solely for the purposes of complying with the opt-out request. (1798.135a)
  • AMBDavis Equity Coaching shall allow a consumer to authorize another person solely to opt-out of the sale of the consumer’s personal information on the consumer’s behalf. (1798.135c)
  • AMBDavis Equity Coaching shall, once it has received direction from a consumer not to sell the consumer’s personal information or, in the case of a minor consumer’s personal information has not received consent to sell the minor consumer’s personal information, stop selling the consumer’s personal information, unless the consumer subsequently provides express authorization for the sale of the consumer’s personal information.   • AMBDavis Equity Coaching shall not sell personal information of consumers where it has actual knowledge that the consumer is less than 16 years of age, unless the consumer, in the case of consumers between 13 and 16 years of age, or the consumer’s parent or guardian, in the case of consumers who are less than 13 years of age, has affirmatively authorized the sale of the consumer’s personal information. Right to no discrimination (1798.125 AB)

  • AMBDavis Equity Coaching shall not discriminate against a Consumer for exercising its rights under California privacy law (such as denying services or charging a different price greater than the value of consumer’s data).
  • Should AMBDavis Equity Coaching provide financial incentives to consumers as compensation for the collection of personal information, they shall be fair and reasonable, and AMBDavis Equity Coaching will require the consumer opt-in their consent in advance in a manner which clearly describes the material terms of the financial incentive program, and which opt-in may be revoked by the consumer at any time.
  • AMBDavis Equity Coaching shall provide a description of a consumer’s rights to no discrimination for exercising its rights under California privacy law in its online privacy policy or policies if the organization has an online privacy policy and in any California specific description of consumers’ privacy rights, or if it does not maintain those policies, on its Internet Web site, and update that information at least once every 12 months.

Right to notice and information

  • AMBDavis Equity Coaching shall, for the purpose of receiving requests for information under the California Consumer Privacy law, make available for consumers at a minimum, two designated methods for submitting requests, including a toll-free telephone number, and if AMBDavis Equity Coaching maintains an Internet Web site, a Web site address.
  • Where such a request is received, AMBDavis Equity Coaching shall disclose and deliver the required information to a consumer free of charge within 45 days of receiving a verifiable request from the consumer (extended only once by an additional 45 days when reasonably necessary, provided the consumer is provided notice of the extension within the first 45- day period).
  • The information is to be delivered through the Consumer’s account with us, if the consumer maintains an account with us, or by mail or electronically at the Consumer’s option if the Consumer does not maintain an account, in a readily useable format that allows the Consumer to transmit this information from one entity to another entity without hindrance.
  • AMBDavis Equity Coaching’s online privacy policy or policies or any California-specific description of consumers’ privacy rights, shall provide a description of a consumer’s rights under California privacy law and one or more designated methods for submitting requests (and shall be updated at least every 12 months).
  • All individuals responsible for handling Consumer inquiries about AMBDavis Equity Coaching’s privacy practices or compliance with California privacy laws are to be informed of all requirements concerning Consumers rights to request information concerning personal information collected, sold or disclosed, Consumers’ right not to be discriminated against and how to direct Consumers to exercise their rights.   • Any personal information collected from a Customer in connection with AMBDavis Equity Coaching’s verification of a Customer’s request is to be used solely for the purposes of verification. (1798.130.a7)

Right to access

  • Where access to customer personal data is provided to a vendor or service provider AMBDavis Equity Coaching shall do so by written contract that: (1) specifies the business purpose for giving the data, (2) prohibits the retention, use or disclosure of that data on your behalf for any other purpose, (3) prohibits the retention, use or disclosure of that data for other commercial purposes, (4) prohibits the retention, use or disclosure of that information outside of the direct business relationship of the parties, (5) prohibits the sale of that data, and (6) requires compliance with California Privacy Laws as to that data including its restrictions on use, disclosure and retention.
  • Where access to customer personal data is provided to a vendor or service provider AMBDavis Equity Coaching shall obtain a certification from the person receiving the data that they understand and will comply with the written contract that: (1) specifies the business purpose for giving the data, (2) prohibits the retention, use or disclosure of that data on your behalf for any other purpose, (3) prohibits the retention, use or disclosure of that data for other commercial purposes, (4) prohibits the retention, use or disclosure of that information outside of the direct business relationship of the parties, (5) prohibits the sale of that data, and (6) requires compliance with California Privacy Laws as to that data including its restrictions on use, disclosure and retention.

 

Limit Personal Data Sharing

You can always limit the personal data you provide to us, but if you choose not to provide certain requested information, you may be unable to access some of the services, offers, and content on the Site. You can also limit the communications that we may send you by following a simple opt-out or unsubscribe process. Simply follow the instructions in our newsletter/advertisement/promotional emails to opt-out of receiving, or unsubscribe from, future marketing communications.

Please note that even if you opt-out of promotional communications, we may still need to contact you with important transactional data about your account. For example, even if you opt-out of promotional communications, we will still send you a notification of changes to, expiration of, or discontinuation of a program you are enrolled in.
